General conditions of Sale

SUPANATTY sells the products on its website (as defined below) exclusively to retail and final consumers. All Orders which clearly do not constitute a retail sale, and in general, any order that is fraudulent or deemed so in the exclusive opinion of SUPANATTY, will be considered null and as never received. The Purchaser declares and guarantees that the purchase of products on the SUPANATTY Internet Site is not carried out in the performance of his professional activity, and is intended for strictly personal use. For the purposes of these General Terms and Conditions of Sale, the Purchaser and are individually or jointly referred to respectively as the Party or Parties. These General Conditions of Sale (hereinafter, «GCS») have the purpose, on the one hand, of informing each potential Buyer on the conditions and methods with which the seller (here in after «SUPANATTY» or «the Seller») carries out the sale and delivery of the products ordered and, on the other hand, to define the rights and obligations of the Parties in relation to the sale of the products by SUPANATTY to you (previously and hereinafter the «Buyer»).

The GCS apply, without limitation or condition, to all sales of the products offered by SUPANATTY on its Website (hereinafter the «Site» or the «Website»), accessible:

- via the Internet at the address www.supanatty.com, as well as, in an optimized version for mobile devices, at the address www.supanatty.com; and - through the «Appstore» service in the form of a mobile application available on devices with the iOS operating system, including, in particular, iPhone, iPodtouch and iPad.

These General Conditions of Sale must be carefully examined by the Purchaser before completing the procedure for purchasing products and/or services via the Website. These General Conditions of Sale can be printed and kept by any person who has visited the Website. The sending by the Purchaser of a purchase order ("Order") for a product and/or service offered for sale on the SUPANATTY Website implies the total and unconditional acceptance of these General Conditions of Sale, as well as the General terms of use of the website.

SUPANATTY reserves the right to modify these General Conditions of Sale at any time. In any case, the General Conditions of Sale applicable to an Order are always those accepted by the Purchaser at the time the Order is sent. These General Conditions of Sale form an integral part of the General Conditions of Use of the SUPANATTY Website, which can be viewed and downloaded at any time in the « Legal Information and Privacy » section of the Website Section A - Information pursuant to art. 49 Consumer Code

PRODUCT CHARACTERISTICS

The Purchaser can select one or more products and/or services from the various categories available on the SUPANATTY Website. SUPANATTY may change the assortment of products offered for sale on its Internet Site at any time, especially according to reasons relating to its suppliers and/or information relating to them such as prices, description or availability of products, without prior notice. SUPANATTY will not make any changes to the price, availability or description of any product after SUPNATTY has accepted the Order sent by the Buyer. Before sending the Order, the Purchaser can view on the SUPANATTY Website all the information referred to in article 49 of Legislative Decree 6 September 2005, n. 206 ("Consumer Code") such as, by way of example and not limited to, information relating to the Seller, the price, including taxes and shipping costs, the essential characteristics of the product/s or the services you wish to purchase and together with all the other mandatory information required by Italian law. The products comply with the applicable legislation in Italy in force at the time of the Order.

SUPANATTY cannot be held responsible for the non-compliance of the products with the legislation of the country to which the Purchaser wishes delivery to take place. The Buyer is required to check with the local authorities of the country of delivery of the products how to import and/or use the products and services he intends to order. SUPANATTY cannot guarantee that the information on the packaging of the products will be translated into all the languages of the European Union.

PRODUCT AVAILABILITY

The offers presented by SUPANATTY are valid for as long as they are published on the Site and within the limits of available stocks. For products not immediately available in the SUPANATTY warehouses, the offers published on the Site will be valid subject to availability. Information on the availability of the products will be provided to the Purchaser when an e-mail confirming receipt of the Order is sent ("Order Confirmation E-mail"). Since this information comes directly from the suppliers, SUPANATTY cannot exclude that errors or variations may occasionally occur. In any case, and in the event that, after sending the Order, there is total or partial unavailability of the product, the Purchaser will be immediately informed by e-mail of the unavailability of the product and of the total or part of the Order. In case of partial cancellation of the Order: - The Purchaser's Order will be partially confirmed with the amount charged only for the products available as indicated in the Order Confirmation email. - The available products will be delivered to the Purchaser.

TERMS OF PAYMENT

Payment can be made online, at the time of the Order, by the Purchaser by credit card. If the Buyer has opted for cash on delivery, he will be required to pay the total amount in cash, including shipping costs and the cash on delivery supplement, upon delivery of the ordered goods. All Orders are payable in Euros, taxes and mandatory contributions included. Any bank charges will be borne exclusively by the Purchaser (even in the event of a refund). In the event of non-payment or late payment of the Order by the Purchaser Supanatty reserves the right to apply default interest at the legal rate of interest starting from the tenth working day following the date of the Order or from the notification of rejection of the bank payment. In any case, Supanatty reserves the right to suspend or cancel, at its discretion and at any time, the execution of an Order and/or the shipment of the products ordered in the event of non-payment or partial payment of any sum charged of the Buyer, in the event of late payment or in the event of fraud or attempted fraud through the use of the Supanatty Website, including in relation to previous Orders.

MEANS OF PAYMENT

The Buyer guarantees to SUPANATTY that he has the necessary authorizations to use the payment method chosen for his Order when sending the Order. The means of payment accepted by SUPANATTY are the following:

• CREDIT CARD The following credit cards are accepted on the SUPANATTY Internet Site and at the SUPANATTY Customer Service:

Visa, American Express and MasterCard.

These payment cards must be issued by a bank or financial institution based within the European Union or in Monaco.

Customers using an iOS device can still pay for their purchases via Apple Pay with an active credit card. Cash on delivery Cash on delivery is the payment method for paying directly upon delivery of the ordered products. It is possible to place cash on delivery orders provided that the Purchaser has a postal address in Italy and for a maximum amount of €100, including shipping costs and the cash on delivery surcharge. This payment method provides for an additional cost. At the time of delivery, the customer will pay the total of the order directly to the courier in cash. For cash on delivery payments, it is advisable to prepare the exact sum for the amount due. It is not possible to integrate this payment method with the use of credit card, Supanatty and/or online vouchers. If the Purchaser has opted for cash on delivery, it will not be possible to use the product customization service offered by Supanatty.

METHOD OF SHIPPING OF THE PRODUCTS FOR ITALY

(i) POSTAL Shipping A Carrier's manager will deliver to the Purchaser or to the recipient of the Order and will ask them to sign an electronic receipt (in the absence of a terminal, it could be paper). This electronic receipt will constitute proof of delivery by SUPANATTY, and of receipt by the Purchaser, or the recipient of the Order, of the ordered products. Deliveries are made on working days (Monday to Friday). In case of absence, the Purchaser, or the recipient of the products ordered, will receive a notice of attempted delivery, with which they can contact the carrier at the address indicated on the notice in order to organize a new delivery. In the event that it is expressly indicated by the purchaser, or by the recipient of the ordered products, it will be possible to deliver the products to a third party. In the event that it is not contacted, the Carrier will carry out a further step, following the first step.

In the event that after two delivery attempts it has not been possible to deliver the package, the Purchaser or the recipient of the Order will receive a notice stating the address of the Carrier's Center where the package will be kept for ten working days. The Purchaser or the recipient of the Order will be able to collect the package from this Centre. At the end of this term, the package will be returned to Supanatty and the Purchaser will be reimbursed, in the manner chosen at Supanatty's discretion, for the amount of his Order minus the shipping and storage costs. It is not possible to raise any dispute relating to the shipment itself in the event that the package has been delivered.

For this purpose, the IT system of the Carrier is authentic - We have NO contact with the driver of the courier who will be entrusted with your package, it is not possible to request a delivery time slot - The driver of the courier who will be entrusted with your the parcel is not required to call the recipient before delivery - By proceeding with the purchase of the products, you guarantee that someone is present at home between 08:30 and 18:30 in the next 24/48 working hours from the date of shipment. - The address provided is checked and is entirely correct and one of the names filled in is present at the bell or sign in the case of non-residential destinations.

CGM The ingredients of the products are always updated by the producers, Supanatty DOES NOT take responsibility in any case, if a product is no longer Curly Girl Method Approved, therefore our dedication to follow the trends will remain constant trying to keep the information always updated . Before buying, please confirm the INCI from official sources. Therefore it is understood that refund mails, returns or other will not be handled in this regard. Prices All prices shown on the Website are inclusive of VAT (where applicable) at the prevailing rates and are correct at the time the information is entered into the system.

However, we reserve the right to change prices at any time, without notice (provided that any changes do not affect orders for which we have sent you a Dispatch Confirmation). Content rights and use The content of the website is protected by copyrights, trademarks, databases and other intellectual property rights. You hereby confirm that the material and content forming part of the Website will remain our property or the property of our licensors. You may access and view the website content on a computer, save such content electronically to disk (but not to servers or other network-attached storage devices), or print one copy for your personal, non-commercial use, provided that all copyright and proprietary notices are kept intact. Otherwise you will not be able to reproduce, modify, copy, distribute or use, for commercial purposes, some of the materials or contents of the website.

The images of all products are purely indicative and strongly identical to the original, it is possible to request before purchasing the photo of the real product that will be shipped. Whilst we will try to ensure that the material included on the website is correct, reliable and of the highest quality, we cannot accept any liability if you do not. We will not be liable for any errors or omissions, or for the results to be derived from the use of this information, or for any problems you may encounter in using the website. If we are advised of any inaccuracies in the material on the website , we will try to remedy it promptly, as reasonably within our possibilities.

Your Account If you use the Supanatty Services, you are responsible for keeping your account and password confidential and for controlling access to your computer and devices, and you agree, to the extent permitted by applicable law, to be held responsible of all the activities that will be carried out with your account and your password. You undertake to take all necessary precautions to ensure that your password remains secure and confidential and you undertake to inform us immediately if you have reason to believe that any third party has knowledge of your password, or if your password is, or is likely to be, used in an unauthorized manner. You are required to ensure that the information you provide to us is correct and complete and to notify us immediately of any changes to the information you have provided. You will be able to access your information from the My Account section of the site.

You shall not use the Supanatty Services: (i) in a manner that causes, or is likely to cause, any interruption, damage, or malfunction of the Supanatty Services and its features, or (ii) for fraudulent purposes, or otherwise to commit any illegal activity, or (iii) to cause inconvenience, prejudice We reserve the right to prevent access to the site and/or the Supanatty Services, to suspend or terminate an account, to remove or modify the contents of the site at our discretion, in case of violation of the applicable legal provisions, these General Conditions of Use or the applicable guidelines or policies.

RIGHT AND TERMS FOR THE EXERCISE OF THE WITHDRAWAL

Pursuant to article 52 of the Italian Consumer Code and without prejudice to the exclusions referred to in article 59 of the same code (see in particular the hypothesis of the supply of sealed goods that do not lend themselves to being returned for reasons of hygiene or related to protection of health and have been opened after delivery), the Buyer may, within 14 (fourteen) days of acquiring physical possession of the package containing the goods ordered or, in the case of the purchase of multiple goods ordered by the Purchaser in a single order and delivered separately, from the acquisition of physical possession of the last purchased good, withdraw from the purchase contract without penalty and without any reason. In the case of purchase of a service, the right of withdrawal may be exercised by the Purchaser, within the term of 14 (fourteen) days starting from the date of conclusion of the contract, provided that the provision of this service has not yet been completed.

The Purchaser, exercising the right of withdrawal in accordance with this article, within the terms and according to the methods described below for the return of the products, will be able to obtain at his choice: reimbursement of the amount paid for the returned products excluding the costs of delivery by re-crediting the relative sum to the credit card (without prejudice in any case to the possibility for the Purchaser to opt for a different credit card on which to credit the refund) the refund will be made as soon as possible and in any case within 14 (fourteen) days from the date on which the Buyer has exercised his right of withdrawal without prejudice to Supanatty's right to withhold the refund until the goods have been returned or until the Buyer has demonstrated that he has sent the goods back object of the Order (whichever occurs first). In the case of cash on delivery, the Purchaser expressly accepts that the refund will be made with an Online Voucher or, in the event that Supanatty is in possession of the customer's bank details, by bank transfer; - the possibility of exchanging the products purchased on the Supanatty website with other products sold on the SUPANATTY website at the price applied on the site at the time of the exchange; or - a credit of an amount equal to the price of the returned products, usable only on the SUPANATTY website. 7.1.4 Costs Pursuant to article 57 paragraph 1 of the Italian Consumer Code, the return costs will be borne exclusively by the Purchaser. 7.2

RIGHT AND TERMS FOR THE EXERCISE OF THE CONTRACTUAL WITHDRAWAL

Wanting to ensure the satisfaction of its Buyers and recipients of Orders, SUPANATTY recognizes the Buyer and/or the recipient of the Order the possibility of withdrawing from the purchase contract, without reason and without paying penalties, even beyond the legal term indicated in above and under the conditions set out below. The right to withdraw pursuant to this article 7.2 is not granted to Buyers in the cases described by article 59 of the Consumer Code in the event of the supply of sealed goods which do not lend themselves to being returned for reasons of hygiene or related to the protection of health and have been opened after delivery. The right to withdraw referred to in this article 7.2 is not in any case granted to Buyers in the case of Orders relating to Personalized Products. 7.2.1

Term for exercising the right of contractual withdrawal The term within which the Purchaser and/or the recipient of the Order may exercise the right of contractual withdrawal is 30 (thirty) days from the date of receipt of the Order.

Procedures for exercising the right of contractual withdrawal.

7.2.2 Methods of exercising the right of contractual withdrawal The methods of contractual withdrawal are described in the article

7.3 of these General Conditions of Sale. 7.2.3

Consequences of exercising the right of contractual withdrawal

The Buyer and/or the recipient of the Order who exercises his right of contractual withdrawal under the conditions set out in this article within the terms and according to the methods described below for the return of the products purchased on the SEPHORA Website, will be able to obtain :

- the possibility of exchanging, only in an Italian SUPANATTY store, the products purchased with other products sold by SUPANATTY; or

- Online vouchers on the SUPANATTY account for a credit of an amount equal to the price of the returned products, usable only on the SUPANATTY website; or 7.2.4 Costs The return costs will be entirely borne by the Purchaser and/or the recipient of the Order, except in the case where the withdrawal follows the delivery of defective, non-conforming, damaged or missing products, in which case SUPANATTY will refund the shipping costs to the Purchaser and/or recipient of the Order.

HOW TO EXERCISE THE RIGHT OF WITHDRAWAL

In the event of the right of withdrawal exercised pursuant to article 7.1, the Purchaser may return the ordered products by sending them by post to the address indicated in article 7.3.3 of these General Conditions of Sale. 7.3.1 General provisions applicable to any method of return (by post) The products must be returned to Supanatty in their substantial integrity, with their original packaging, accessories, instructions for use and anything else supplied with them. To exercise the right of withdrawal pursuant to articles 7.1 and 7.2, the Purchaser and/or the recipient of the Order must complete the appropriate Return Form, which can be downloaded from the Supanatty Website in the Help Section and must be duly signed, taking care to include the Order number (if this field has not already been filled in on the Return Form); alternatively and limited to the withdrawal pursuant to article 7.1, the Purchaser may communicate the withdrawal to Supanatty through an explicit declaration (eg a letter sent by post, fax or e-mail sent to the address indicated in article 1).

To meet the withdrawal deadline, it is sufficient for the Buyer to send the Return Form or the explicit communication before the expiry of the applicable withdrawal period. Using the Return Form makes it easier for Supanatty to manage the return process. The Buyer or the recipient of the Order, if different from the Buyer, is then invited to use the Return Form. For returns in Italian Supanatty stores it is necessary to present a copy of the purchase invoice. In the event of withdrawal, the return of the products must take place without undue delay and in any case no later than 14 (fourteen) days from the date on which the Purchaser communicated his decision to withdraw from the contract.

For services purchased on the Supanatty Site, the return conditions described below will be applicable provided that the provision of services has not yet been completed. 7.3.3 Return by post Without prejudice to article 7.3.1 of these General Conditions of Sale, the Purchaser or the recipient of the Order who wishes to exercise his right of withdrawal, legal or contractual, by returning a product by post, must follow these instructions: - use the original packaging to return the products in question - send the package to the following address: BIB Nation Fraz Barche Chez Sapin 87 Fenis,11020 Supanatty only accepts correctly addressed parcels or registered letters.

Any risk connected with the return of the products will be exclusively borne by the Purchaser and/or recipient of the Order, except in the case in which the Purchaser, recipient of the Order, fails to demonstrate that he has deposited the products to be returned with a carrier or at a Supanatty store.

FORMATION OF CONTRACT AND DISPATCH EACH ORDER SENT BY THE PURCHASER CONSTITUTES ACCEPTANCE OF LEGAL INFORMATION AND PRIVACY, AND CONSTITUTES AN OFFER TO PURCHASE SUPANATTY PRODUCTS.

Orders are subject to acceptance by SUPANATTY which reserves the right, at its sole discretion, to refuse the Order, including cases where: (i) the orders cannot be executed due to an error in the information provided by the Buyer to the time of placing the Order (for example: an incorrect payment card number, expiration date or security code number of the card used for payment); incorrect billing address (for example if the billing address indicated does not match the information held by the bank or company that issued the payment card); insufficient or incorrect shipping address (for example, incorrect address, city, country or zip code); or if misleading information is provided by the Purchaser; (ii) an error has occurred on the Website relating to the products ordered, for example an error relating to the price or description of the products as displayed on the Website; (iii) the products ordered are no longer available on the Website.

SUPANATTY also reserves the right to suspend or cancel the fulfillment of an Order and/or delivery, regardless of the nature and progress of the fulfillment, in the event of non-payment or partial payment of any amount due by the Purchaser, in in the event of payment problems, or in the event of fraud or attempted fraud relating to the use of the SUPANATTY Website, also with reference to previous Orders.

In the event of refusal of the Order, SUPANATTY will notify the Buyer, within 30 working days of placing the Order, of the impossibility of accepting the Order. The Purchaser will be able to check the details of his Order and correct any errors before confirming/sending the Order. Once the Purchaser confirms the Order by clicking on «Confirm Payment», the Purchaser declares to have knowingly accepted the content and conditions of the Order in question and, in particular, these General Conditions of Sale, the prices , volumes, characteristics, quantities and delivery times of the products offered for sale and ordered by the Purchaser. After placing the Order, the Purchaser will not be able to modify and/or cancel it. The sale will be final only upon acceptance of the Order by SUPANATTY, by sending an e-mail confirming the receipt of the Order to the Buyer, the Order Confirmation email. A second email will be sent to the Buyer upon shipment of his Order.

SUPANATTY will be entitled to collect the full price of the Order:

- for payments made by credit card, SUPANATTY and/or online vouchers: from the time the Order Confirmation Email is sent;

- for payments made with other payment methods described in article 5.2: from the moment of sending the e-mail informing the Purchaser of the despatch of the ordered products.

SUPANATTY recommends that the Buyer keep the emails received from SUPANATTY in paper or electronic form. The Purchaser is informed that the aforementioned e-mails will be sent to the e-mail address entered by the Purchaser when creating the Account and/or subsequently registering. SUPANATTY will not be liable in the event of entering an invalid e-mail address and/or failure to receive the Order Confirmation E-mail for reasons not directly attributable to SUPANATTY. In this case the sale will be considered definitive. However, the Purchaser may exercise the right of withdrawal under the conditions set out in article 7 of these General Conditions of Sale. 10.2.

LIMITATION OF LIABILITY

SUPANATTY will not be in any way responsible for any violations of these General Conditions of Sale, even if foreseeable, attributable to the fact of a third party, to the Buyer's fault, to the occurrence of an event of force majeure or to any other event that is not reasonably under the exclusive control of SUPANATTY. The information and contents available on the Website are provided "AS IS" (as they are) and SUPANATTY does not give any guarantee of any kind, either express or implied, in relation to the integrity, accuracy, timeliness, non-infringement of third party rights, availability, reliability or completeness of the information and contents, including but not limited to, information on products, accessories or services appearing on the SUPANATTY Website and/or their suitability for a specific use.

SUPANATTY DECLINES ALL LIABILITY FOR DIRECT AND INDIRECT DAMAGES, WHETHER FORESEEABLE OR NOT, CONSEQUENTIAL AND/OR CONNECTED TO THE PURCHASER'S USE OF THE WEBSITE. IN THE EVENT THAT SUPANATTY IS HELD LIABLE FOR A DAMAGE SUFFERED BY THE PURCHASER WHICH IS attributable SOLELY TO THE TRANSMISSION OF AN ORDER, SUCH LIABILITY SHALL BE LIMITED TO THE AMOUNT OF THE ORDER PAID BY THE PURCHASER TO SUPANATTY.

Nothing in these General Conditions of Sale excludes or limits SUPANATTY's liability towards the Purchaser and/or recipient of the Order for fraud, death or personal injury caused by SUPANATTY's negligence, violation of the applicable provisions of the Italian Consumer Code or any other liability which cannot be excluded or limited by law. Any claim made by users of the Site, including all Buyers, against SUPANATTY must be made within six (6) months following the occurrence of the event which is the subject of the claim

The information and contents available on the Website are provided "AS IS" (as they are) and SUPANATTY does not give any guarantee of any kind, either express or implied, in relation to the integrity, accuracy, timeliness, non-infringement of third party rights, availability, reliability or completeness of the information and contents, including but not limited to, information on products, accessories or services appearing on the SUPANATTY Website and/or their suitability for a specific use. SUPANATTY will not be in any way responsible for the improper use of the products and/or services by the Purchaser and/or recipient of the Order, and in particular for the case of non-compliance with the instructions for use of the products. SUPANATTY will not be liable in any way for any damages caused to the Purchaser or to third parties deriving from said non-compliant use.

RESPONSIBILITY

The Purchaser declares to have full capacity to act and stipulate a contract for the purchase of products and/or services on the Website on the basis of these General Conditions of Sale. Supanatty shall under no circumstances be required to verify the ability to act of visitors and Buyers of the Supanatty Website. In the event that a person not having the necessary capacity to act (for example a minor) places an Order on the Supanatty Website, without prejudice to the responsibility of their parents or legal guardians for this Order and the related payment, Supanatty may refuse to accept the Order.

LIMITATION OF LIABILITY SUPANATTY will not be liable in any way for any violations of these General Conditions of Sale, even if foreseeable, attributable to the fact of a third party, to the Buyer's fault, to the occurrence of a force majeure event or to any other event which is not reasonably under the sole control of Supanatty.

The information and contents available on the Website are provided "AS IS" (as they are) and Supanatty makes no warranties of any kind, either express or implied, in relation to the integrity, accuracy, timeliness, non-infringement of third party rights, availability, reliability or completeness of the information and contents, including but not limited to, information on products, accessories or services appearing on the SUPANATTY Website and/or their suitability for a specific use.

PERSONAL DATA

SUPANATTY collects and processes the personal data of the Purchaser and, where applicable, those of the recipient of the Order in order to provide its products and services in accordance with these General Conditions of Sale. For information concerning the processing of personal data of the Purchaser and possibly of the recipient of the Order by SUPANATTY, please consult the Privacy Policy of the Site, available at the following address: Legal information and privacy MODIFICATIONS SUPANATTY reserves the right to modify and update the General Conditions of Sale without notice. To be informed of these changes, SUPANATTY advises the Purchaser, and any user in general, to regularly read these GCS and the "Legal information and privacy". The purchase of products on the Website will be subject to the GCS in force at the time the Order is sent. The changes will not be applied to Orders already sent and accepted by SUPANATTY.

PARTIAL INVALIDITY GENERAL CLAUSES

If one or more provisions of these GCS is declared invalid or ineffective due to a legislative change or following a ruling by a competent judicial authority. The other provisions of these GCS will remain fully valid and effective.

17.2 WAIVER The circumstance that one of the Parties does not assert against the other a violation of any of the obligations contained in these GCS, will not be understood as a waiver to obtain fulfillment of the obligation in question for the future.

17.3. APPLICABLE LAW AND APPLICABLE JURISDICTION These GCS and all product sales on the Website are governed by Italian law, regardless of the place of shipment of the Order.

ANY DISPUTE RELATING TO THE EXISTENCE, INTERPRETATION, EXECUTION OR TERMINATION OF THESE GCS AND/OR THE CONTRACT CONCLUDED BETWEEN THE PURCHASER AND SUPANATTY, SHALL BE REFERRED, IN THE ABSENCE OF A SETTLEMENT, TO THE EXCLUSIVE JURISDICTION OF THE ITALIAN COURTS COMPETENT ACCORDING TO THE PLACE OF RESIDENCE OR DOMICILE OF THE PURCHASER, IF LOCATED IN THE ITALIAN TERRITORY.
